01Definitions
In these Terms and Conditions, the following words carry the meanings set out below:
- "Auroral", "we", "us", or "our" refers to Auroral, a financial literacy education provider registered and operating from Jalan Bangsar 76, 59000 Kuala Lumpur, Malaysia.
- "Service" refers to any workshop, reading group, reading track, or other educational programme offered by Auroral, including access to associated printed and digital materials.
- "User", "you", or "your" refers to any individual who accesses our website or registers for one of our programmes.
- "Content" refers to all text, documents, printed companions, glossaries, session recordings, and materials produced or distributed by Auroral as part of any Service.
- "Agreement" refers to the contract formed between you and Auroral when you register for a Service or use our website, incorporating these Terms and Conditions and our Privacy Policy.
- "Website" refers to the Auroral website accessible at auroralx.biz.
02Acceptance of Terms
By using our Website or registering for any Auroral programme, you confirm that you have read, understood, and agree to be bound by these Terms and Conditions, together with our Privacy Policy. If you do not agree to these Terms, you must not use our Website or register for any Service.
To register for a Service, you must be at least 18 years of age and have the legal capacity to enter into a binding agreement. By completing registration, you represent that these conditions are met.
03Service Description
Auroral offers structured literacy programmes focused on reading and understanding the language and structure of mortgage-related documents. Our current programme offering includes:
- Reading Mortgage Documents Workshop — A two-evening literacy workshop covering document structure, vocabulary, and the calm reading of sample materials. Includes a printed glossary. (RM 580)
- Mortgage Literacy Reading Group — A six-week facilitator-led reading and discussion group based on publicly available document samples and accessible literature. Includes a printed reading companion. (RM 1,840)
- Annual Mortgage Reading Track — A twelve-month structured reading track with monthly sessions, quarterly assignments, and a printed annual companion. (RM 4,580)
Programme schedules, session dates, and delivery formats are published on our Website and may change. Auroral will give reasonable advance notice of any material changes to scheduled sessions.
Our services are designed for residents and individuals based in Malaysia. We do not restrict access by nationality but cannot warrant that our content is relevant to mortgage documentation frameworks in other jurisdictions.
04Enrolment and Participation
Enrolment in a programme is completed when you submit a registration enquiry through our Website and receive a written confirmation from Auroral, following payment of the applicable fee.
You are responsible for ensuring the accuracy of any information you provide during registration, including your name, contact details, and any other details required for programme administration.
Auroral reserves the right to decline an enrolment request at its sole discretion, in which case any payment received will be refunded in full.
Participation in sessions is your own responsibility. Auroral does not operate an attendance recording system that affects programme completion, but some materials or reading assignments may be distributed during scheduled sessions.
05User Responsibilities
When participating in any Auroral programme or using our Website, you agree to:
- Engage respectfully with facilitators and other participants during group sessions.
- Use all provided materials for personal, non-commercial educational purposes only.
- Refrain from recording sessions without the prior written consent of Auroral.
- Not share, reproduce, or distribute any Content provided by Auroral to third parties without written permission.
- Not use session discussions or facilitator guidance as a substitute for professional financial, legal, or mortgage advisory services.
- Not disrupt, interfere with, or attempt to gain unauthorised access to our Website or its supporting systems.
Auroral reserves the right to remove any participant from a programme if their conduct materially disrupts other participants or is inconsistent with the educational purpose of the session.
06Intellectual Property
All Content produced by Auroral — including printed glossaries, reading companions, session outlines, handouts, and Website materials — remains the intellectual property of Auroral. Nothing in these Terms transfers ownership of any intellectual property to you.
Upon enrolment and payment, Auroral grants you a limited, personal, non-exclusive, non-transferable licence to use the Content provided as part of your enrolled programme, solely for your own private educational use.
You may not reproduce, copy, publish, sublicense, sell, or otherwise distribute any Content without Auroral's prior written consent. Any publicly available source documents referenced in sessions are subject to their own terms and licences.
07Payment Terms and Refunds
Programme fees are stated in Malaysian Ringgit (RM) and are inclusive of all programme materials unless otherwise specified.
Payment
Payment is due at the time of enrolment confirmation. Auroral accepts payment via bank transfer, online payment gateway, or such other methods as communicated during the registration process.
Refund Policy
- More than 14 days before programme start: A full refund will be issued, less any applicable bank or processing charges.
- 7 to 14 days before programme start: A 50% refund will be issued.
- Less than 7 days before programme start: No refund will be issued, but a credit towards a future programme may be offered at Auroral's discretion.
- If Auroral cancels a programme: A full refund will be issued to all enrolled participants within 14 working days.
For multi-session programmes where sessions have already commenced, refunds are calculated on a pro-rata basis for sessions not yet delivered, less an administration fee of RM 100.
08Educational Scope and Limitations
All Auroral programmes are strictly educational in nature. Our sessions address the vocabulary, structure, and reading comprehension of mortgage-related documents in a general sense.
Auroral does not provide, and nothing in our programmes should be interpreted as constituting, financial advice, mortgage advisory services, legal advice, or any recommendation regarding any specific financial arrangement, product, or decision.
Facilitators and staff at Auroral are not licensed financial advisers, mortgage brokers, or solicitors. Any questions regarding your specific circumstances should be directed to an appropriately licensed professional.
09Disclaimers
The Website and all Content are provided on an "as is" basis without warranties of any kind, express or implied. To the fullest extent permitted by Malaysian law, Auroral disclaims all representations and warranties, including that:
- The Website will be uninterrupted, error-free, or secure;
- Programme content will produce any particular outcome for participants;
- Third-party documents referenced in sessions are accurate or current;
- The Website is free from viruses or harmful components.
Auroral makes no representation that the content of its programmes covers every aspect of mortgage documentation in Malaysia or elsewhere, or that participation in a programme equips a participant to make any specific decision.
10Limitation of Liability
To the fullest extent permitted by applicable Malaysian law, Auroral's aggregate liability arising out of or in connection with these Terms — whether in contract, tort, or otherwise — shall not exceed the total programme fees actually paid by you in the twelve months preceding the event giving rise to the claim.
In no event shall Auroral be liable for any indirect, incidental, special, consequential, or punitive loss or damage, including loss of profit, revenue, data, goodwill, or business opportunity, even if advised of the possibility of such loss.
Auroral shall not be liable for any failure or delay in performing its obligations where such failure or delay arises from circumstances beyond its reasonable control, including natural events, public health emergencies, or utility failures.
11Indemnification
You agree to indemnify, defend, and hold harmless Auroral and its directors, facilitators, staff, and representatives from and against any claims, damages, costs, and expenses (including reasonable legal fees) arising from your breach of these Terms, your misuse of any Content, or your violation of any applicable law or third-party right.
12Termination
Auroral may, without liability to you, restrict or terminate your access to any programme or the Website if you breach these Terms or if Auroral reasonably determines that your continued participation is not appropriate.
You may withdraw from a programme at any time subject to the refund terms in Section 7. Withdrawal does not affect obligations that have already accrued.
Sections 5, 6, 9, 10, 11, and 13 survive any termination of this Agreement.
13Dispute Resolution
These Terms are governed by and construed in accordance with the laws of Malaysia. Any dispute arising from or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Malaysia.
Before initiating formal proceedings, you agree to attempt to resolve any dispute informally by contacting Auroral at [email protected]. We will make a reasonable effort to address your concern within 15 working days.
If informal resolution is not achieved, either party may refer the matter to mediation through the Malaysian Mediation Centre before proceeding to litigation.
14General Provisions
- Entire Agreement: These Terms, together with the Privacy Policy, constitute the entire agreement between you and Auroral regarding the subject matter herein.
- Severability: If any provision is found to be unenforceable, the remaining provisions continue in full force and effect.
- Waiver: Failure by Auroral to enforce any provision does not constitute a waiver of that provision.
- Assignment: You may not assign any rights or obligations under these Terms without Auroral's prior written consent. Auroral may assign its rights and obligations in connection with a business transfer.
- Notices: Notices from Auroral will be sent to the email address you provided at registration. Notices to Auroral should be sent to [email protected].
15Changes to These Terms
Auroral may update these Terms from time to time. When we do, we will revise the "Last Updated" date at the top of this page. For material changes that affect enrolled participants, we will provide at least 14 days' notice by email before changes take effect.
Your continued use of our Website or enrolment in any programme after revised Terms are published constitutes your acceptance of those changes.
